Article 2 – Scope
These general terms and conditions of sale (the “Terms of Sale”) apply to sales concluded on the Site between the Seller and any natural person acting for non-professional purposes (the “Customer”). The Customer accepts them by checking the box provided or by confirming their order. The applicable version is the one online on the date of the order; the Customer may save and print it.
Article 3 – Products
Our products are comfort and everyday-support accessories (such as posture correctors, walking canes and lumbar supports). They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Their essential characteristics (materials, dimensions, sizes, adjustment, maximum load where relevant, instructions for use and safety precautions) are set out on each product page. Lifestyle photographs are not contractually binding. Choose the size using the size guide where one is provided, follow the instructions for use, stop using a product that causes pain or discomfort, and ask a doctor or healthcare professional for advice if you have pain, an injury or a medical condition.
Article 4 – Prices
Prices are shown including all taxes. Shipping is free on every order, in France and internationally (see our Shipping Policy); the total displayed before payment is confirmed is the final amount. Bundle offers (for example 2 or 3 products) are applied automatically in the cart. Discount codes apply under the conditions stated with the offer (for example, the welcome code can be used once per customer). The price charged is the one displayed when the order is confirmed.
Article 5 – Ordering
- The Customer selects products and adds them to the cart.
- The Customer enters their contact details and shipping address, then chooses the shipping method.
- The Customer reviews the order summary (products, prices, fees, total) and can correct any errors.
- The Customer confirms the order by clicking the payment button, which constitutes an order with an obligation to pay.
The contract is concluded when payment is confirmed. The Seller promptly sends an order confirmation by email, setting out the information of the contract. The Seller may refuse an order in the event of a previous payment dispute or suspected fraud.
Article 6 – Payment
The price is payable in full at the time of ordering, using the payment methods offered at checkout. Payments are processed by secure payment providers; the Seller never has access to your full card details.
Article 7 – Delivery
Products are delivered within mainland France and internationally, in the countries offered when ordering, to the address provided by the Customer. Delivery takes 5 to 8 days from the order, in France and internationally. For deliveries outside the European Union, any customs duties and import taxes charged by the destination country are payable by the Customer. If no other date has been agreed, delivery takes place no later than 30 days after the order (Article L.216-1 of the French Consumer Code). The risk of loss or damage passes to the Customer when they take physical possession of the products (Article L.216-4). In the event of a delay, the Customer has the rights provided for in Articles L.216-6 and L.216-7 of the French Consumer Code. Full details are set out in our Shipping Policy.
Article 8 – Right of withdrawal
Period. The Customer has 30 days from receipt of the products to withdraw, without having to give any reason. This period goes beyond the 14-day statutory period provided for in Articles L.221-18 et seq. of the French Consumer Code. Where an order for several products is delivered separately, the period runs from receipt of the last product.
How to withdraw. The Customer informs the Seller of their decision before the period expires:
- online, via the “Withdraw from contract here” link, shown at the bottom of every page of the Site and accessible directly at movmel.com/pages/renoncer-au-contrat, without creating an account. The Customer enters their name, order number and email address, then clicks “Confirm withdrawal.” An acknowledgment of receipt is sent to them by email;
- or by any unequivocal statement sent to support@movmel.com or by mail to the customer service address, for example using the model form provided in our Return and Refund Policy.
Returning the products. The Customer returns the products to the customer service address (Wall Agency — Movmel) no later than 14 days after communicating their decision. Return shipping costs are borne by the Customer. The Customer is liable only for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
Unused products. Beyond the 14-day statutory period, the extended 30-day period only applies to unused products, complete and in their original condition and packaging. A product that has been worn, adjusted to the body, used, washed or soiled cannot be returned under this extended period.
Exception. In accordance with Article L.221-28, 5° of the French Consumer Code, the right of withdrawal cannot be exercised for products delivered sealed which have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection.
Refund. The Seller refunds all amounts paid no later than 14 days after being informed of the withdrawal, using the same payment method as that used for the order, unless the Customer expressly agrees to a different method, and at no cost to the Customer. The Seller may withhold the refund until the products have been received or until the Customer has provided proof of having shipped them, whichever is earlier.
Article 9 – Legal guarantees
The Seller is bound by the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). To invoke them, the Customer contacts customer service at support@movmel.com. In this context, the costs of returning the product are borne by the Seller.
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the intended period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to first request repair or replacement of the goods.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
Article 10 – Customer reviews
The reviews displayed on the Site come from our suppliers’ platforms, where they were posted by buyers of the product. They are translated into the language of the Site, published with their original rating, and are not given in exchange for any consideration. Their origin is indicated below the list of reviews.
Article 11 – Personal data
The Customer’s data is processed in accordance with our Privacy Policy.
Article 12 – Customer service and mediation
For any complaint, the Customer first contacts customer service at support@movmel.com. If the dispute is not resolved, the Customer may refer the matter free of charge to the consumer mediator, within one year of their written complaint to the Seller (Articles L.612-1 et seq. of the French Consumer Code):
CNPM – Médiation de la consommation, 27 avenue de la Libération, 42400 Saint-Chamond — cnpm-mediation-consommation.eu.
Article 13 – Governing law and courts
These Terms of Sale are governed by French law. This choice does not deprive the Customer of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute, the Customer may bring proceedings before the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
